The prisoners sentenced to incarceration are divided into two major facilities in accordance to their crime. Those who violate United States federal law are placed in federal prisons, whereas those who violate territorial laws and/or state laws are placed in territorial or state prisons allowing authorities to monitor and analyze criminal acts in their jurisdiction.

There is a criminal register for the Netherlands. The Netherlands took part in the Network of Judicial Registers pilot project, with 10 other countries, exchanging information on criminal records electronically.[31] As of 2004, the criminal record system of the Netherlands takes the form of a computerized system. This was brought about in order to reduce the manual labour associated with the previous system.[78] The data is owned by the Judiciary Information Service[78]

Stalk anyone, ever. It should go without saying, but using background check services makes it far too easy for people step over the line. Remember, even if you’re trying to reconnect with an old friend or ex-lover, many people don’t want to be contacted and don't realize their contact information is out there. As such, you should never use the information to do the following:

The full and detailed records of a one's criminal past can be available to a certain range of individuals and authorities, under the terms 'general use' and 'judicial use'. Under Article 575, general use dictates criminal records will and can be supplied for prospective members of the Bar, future notaries and chartered accountants as they are a prerequisite for registration.[46]
The Fair Credit and Reporting Act disclaimers are posted on each of these service’s websites and state you cannot use the information to screen applicants for your business, but there is no process to ensure you follow the law or the accuracy of the background check information. And, as the NCLC’s report argues, this hurts your business, not just because it's illegal but because you could lose valuable applicants based on inaccurate information. Following background check procedures laid out in the FCRA helps protect your business. It requires you do the following:
A background check is a process a person or company uses to verify that a person is who they claim to be, and provides an opportunity for someone to check a person’s criminal record, education, employment history, and other activities that happened in the past in order to confirm their validity. Whether you’re applying for a job, looking for a new apartment, or purchasing a firearm, you may have to undergo a background check.
Believe it or not, almost all of this information is public record by law, and is available to anyone who is willing to make the effort to search for it. Some jurisdictions make it incredibly simple, and have dedicated web portals that allow you to search. Others are stuck in the paper age, and often require an on site search in the county courthouse. This can be done by using a “court runner”, as well.

All states have official "statewide repositories" of criminal history information that include information contributed by the various county and municipal courts and law enforcement agencies within the state.[101] State repositories are usually accurate, but all states have provisions for the correction of errors that occur in the reporting and recording of criminal history information. Individuals may normally obtain their own records from the state, but to obtain the records of another person, a private individual will normally need to obtain a release from the subject of the record search.[102]

Go to your local police department where you reside or last resided in the United States, request that the police conduct a local or state criminal records search and provide you with a document reflecting that there is no history of a criminal record. Local police departments may require your personal appearance in order to conduct the search.  You should determine whether the country where you intend to use the records check requires that it be authenticated. For information on that process please see our authentications page.

The Czech Republic took part in the Network of Judicial Registers pilot project, with 10 other countries, exchanging information on criminal records electronically.[31] The criminal record system of the Czech Republic is a computerized system. Criminal record information is maintained at the Criminal Records Office in Prague—which is state-funded and can be found at the offices of the Ministry of Justice.[32]
Each criminal record certificate has two components: the first regarding the individuation of the person and the second consisting of the content of the person's prior criminal acts. Every certificate must contain: information concerning the person's identity including the paternal surname and if they are married, and the final judgement/s passed down by a court. Specifically, Article 574.2 CCrP states that certificates must record:
Many courts haven’t digitized their criminal records yet, which means they aren’t available online. If the information is not online, then background check services can’t use web scraping software to collect criminal records from the court. In these instances, some services have a court runner service where they send a person to the courthouse to physically pull the public files. This person is a court runner, trained on digging through files and retrieving information.
There is a centralised criminal record system, there is only one centralised database where the final criminal conviction issued by a Slovak criminal court is registered. This database is in electronic form and is maintained a unit within the General Prosecutors office of the Slovak Republic. The relevant legislation for this is governed by the Act on Criminal Records.[87] As of 2008 there was a proposed bill that these criminal records could only be accessed by request to the General Prosecutors office when the person in question was up for a position which required a clean criminal record. Certain criminal records are not accessible at any time for instance the criminal record/record details of the President of the Republic of Slovakia are not available to anyone during his/her time in office.[88] The criminal records and persona details of everyone held by the General Prosecutors office are lifelong, and continue to be updated throughout their life, every time they move address/change name etc.
We’re big fans of free - so if you’re looking for one or two pieces of information, it might be worth your time to see what’s available first online or in your local courthouse. Online background check services really shine in two ways. They spend a fortune sucking up all the data available, something that might take you years or you might not even be able to accomplish with a limited budget at all. They’re also really good at collecting all the specific information and creating a really detailed report. Generally speaking we’ve found the relatively low cost to be worth the information provided and the sheer time and effort saved on our part.
Cultivate Your Online Presence: Ensuring you don’t leave embarrassing or inflammatory breadcrumbs behind is important, but you also need to cultivate an online reputation an employer wants to see. Share and comment on industry articles. Show you have active interests, especially within the industry you work in. Having no digital footprint is actually worse than having a bad one.
The Central Criminal Records Registry is not publicly accessible and therefore very few public agencies and no private agencies have access to it. This has been confirmed by the New Penal Code (1995) Art.136.4. Therefore, the Central Criminal Records Registry is only accessible to judges, public prosecutors and the judicial police for investigative purposes. Other cases where direct access can be granted include: Guardia Civil for gun permits and border control police. Besides judges, prosecutors and some police agencies, only the recorded subject may request a copy of their personal Conviction Record.[91]
Generally speaking, the disclosure of a criminal record is only released to the individual who committed the offense and only when that individual has handed power of attorney to another or they are declared legally incompetent may another successfully apply to receive the disclosure. Perspective employers are not allowed access to disclosure at any time.[43] Applications must be made through the Casier Judiciare National (National Judicial Record, CJN) and are free of charge. Applications can be submitted online, via email, in person or by post of fax but are limited to the CJN. Criminal record certificates cannot be accessed through a French consulate or embassy at any time.
The identity theft you should worry about is identity takeover. This is when someone uses your personal information to open new accounts, credit cards and loans. However, this kind of identity theft is rare, occurring to only 4 percent of the people who experience identity theft. So even with all the data breaches occurring each year, the chances your information will be purchased on the dark web is almost on par with winning the lottery. Albeit a terrible kind of lottery.

If an individual has pleaded guilty or been found guilty of a sexual crime, they are required to register as a sex offender. This database is maintained by the U.S. Department of Justice and it’s completely free to use. If you don’t know the person’s name, like a new neighbor, you can even enter your address and see if there are sex offenders living within three miles.
All the information included in the background reports sold by these services is public information. You could, if you had the time and patience, find the information on your own. This is the value background check services provide – they do the legwork for you by using web-scraping software to mine public data or by purchasing information in bulk from companies, like Facebook and Twitter, who require users to agree to terms allowing the company to sell their information. Once the services have the public information, they collate it into a report for easy reading.
When police take a person into custody, he or she is under arrest. The arrest can happen following an investigation or immediately after a crime is committed. Law enforcement agencies across the United States keep detailed arrest records that contain the criminal history of individuals who committed crimes. A document that details a person's history is called an Arrest Record, or a Criminal Record.
A chapter 7 bankruptcy is the most common among individuals, though businesses can file it as well. People file for this when their debt is unmanageable. It requires the court to make an evaluation of the debtor’s possessions and assets. The process starts by liquidating non-exempt property to repay as much of the debts as possible: second homes, secondary vehicles, stocks, bonds, available cash, valuable heirlooms and any other high-value possessions. If there is still unpaid debt, the person’s exempt property is liquidated to repay debt: household items, clothing, tools of a trade, personal vehicles.
Once you have received your Record Review response, if you want to challenge the contents of your criminal record, you must complete the "Claim of Alleged Inaccuracy or Incompleteness" (form BCIA 8706), which will be included with your Record Review response if there is criminal information on your record. Mail the completed form, along with a copy of your criminal history record, to the address indicated on the form. Your challenge must specifically state the basis for the claim of inaccuracy or incompleteness and include any available proof or corroboration to substantiate your claim.
The answer to this question depends on which state actually filed the charges. Some states automatically delete and destroy any arrest records on individuals who were not convicted of a charge following an arrest. Sometimes individuals are detained but never officially arrested, usually due to the fact that the officer could not find probable cause after an investigation. In most instances, individuals are not detained unless an officer thinks they can find probable cause through a warrant or if they believe the individual has crucial information regarding a crime. Even persons who have knowledge of a crime can be suspected of involvement as an accomplice. Law enforcement officials regularly use this option to file charges and arrest the suspected informant, even when the chance they would be acquitted is high. And, sometimes this involvement will at least generate an arrest record.
There is no record of dismissed cases or verdicts of not guilty.[6] To access their own criminal record, a person can seek it from their local police authority or send a written request to the Federal Public Service Justice. In terms of public access to criminal records, the following persons and judicial and administrative bodies may be able to gain access to records through the Federal Public Service Justice.
An individual requiring an apostille or authenticated copy of his/her FBI Identification Record, or any non-U.S. national or permanent resident who wishes to request his/her FBI Identification Record must submit a request directly to the FBI CJIS Division. The U.S. Department of State Authentications Office may then place an apostille document for use in a country that is party to the Hague Apostille Convention. For countries not party to the Hague Apostille Convention, the U.S. Department of State Authentication Office will place a certification over the FBI seal.

In the United States, any person, including a private investigator, criminal research or background check company, may go to a county courthouse and search an index of criminal records by name and date of birth or have a county clerk search for records on an individual. Such a search may produce information about criminal and non-criminal charges that do not otherwise appear on a state criminal history abstract.
When people hear “background check,” they usually think about the kind an employer or landlord runs before making a decision. The background check services we reviewed are different from those used to make rental, lending or hiring decisions. The Fair Credit Reporting Act, explained in further detail below, actually makes it illegal to use reports from the background check services we reviewed for any decisions related to potential employees, renters or borrowers. In fact, it would be illegal to use these background check reports to decide on which babysitter to hire.
Criminal records in the United States contain records of arrests, criminal charges and the disposition of those charges. Criminal records are compiled and updated on local, state, and federal levels by government agencies, most often law enforcement agencies. Their primary purpose is to present a comprehensive criminal history for a specific individual.

A person can obtain a copy of their criminal history from the National Criminal Register, by contacting the central information office of the KRK in Warsaw, or information points of the KRK located within Polish common courts.[84] In order to receive a copy of your criminal record, you must complete a form, stating the reasons for your request, and pay a fee (in July 2018: 20PLN for a digital copy, or 30PLN for a paper copy). An employer may also apply directly for disclosure in relation to a prospective employee if this is permitted under Polish laws or regulations (for example, in relation to employment in the security industry or employment involving contact with children). The written consent of the individual is not required.
A fingerprint background check, or Identity History Summary, is often used in conjunction with other background checks and is most often used as part of the pre-employment screening process. A fingerprint background check is mandatory for government-run institutions such as public schools, airports, law enforcement agencies, hospitals, and fire departments.
