Many background check website services advertise their background check, court records, and other services as free services. However, to compile an arrest record report or any other background check report for that manner, costs money. There is always a free when you pull an arrest record report. The search may be free, but in order to pull a complete report, you will have to sign up for a membership. Arrest Records can be obtained for free on your own, but requires a lot of work to find the appropriate court records, or arrest records you are looking for. Arrest records can show up on background check reports when you perform a people search or a background check on someone. Convictions, felonies and other related court documents may also show up on a background check report, but this varies from person to person.

Embezzlement is a crime with different motivations than other crimes, according to a Hiscox Study on embezzlement. Perpetrators are often trusted, long-time employees who came into tough times, such as a sick family member. It typically starts out with small amounts, but as they go uncaught, the amount of damage an embezzler can do to a company is dramatic. According to the study, the average loss a business absorbs over the lifespan of an embezzlement is $807,443.
Pre-employment screening refers to the process of investigating the backgrounds of potential employees and is commonly used to verify the accuracy of an applicant's claims as well as to discover any possible criminal history, workers compensation claims, or employer sanctions. For example, CBC News of Canada reported that fraud in the workplace cost Canadian Businesses over $3.2 Billion in 2011.[6]

In the 21st century, there has been controversy about for-profit data mining companies that harvest much of the electronic booking blotter records from various police authorities[104] nationwide and offer it free on the public Internet and for sale to employers. Though frequently effective at identifying applicants with criminal backgrounds, the mined data does not usually reflect subsequent results of any criminal prosecution, acquittal, or dismissal of charges,[105] and the highly prejudicial nature of such records can damage applicant chances for jobs and other benefits when such records are not in proper context of subsequent prosecutorial result for a hiring manager or recruiter to evaluate. In many cases, records are available for seven years[106] or more beyond acquittals or dismissal of charges. In addition, since arrest records can sometimes be mistakenly matched to individuals with the same or similar names, the prejudicial nature of the available records, particularly violent ones, can negatively affect applicants and candidates in a dramatic way when they otherwise have no actual criminal record.[107]
The Danish criminal record certificate is titled "Privat Straffeattest" and is the responsibility of the National Police Authority (the Rigspolitiet). The Danish Data Protection Agency governs the legislation in relation to criminal records and provides certain restrictions. Criminal convictions on the certificate include all violations of the Denmark Criminal Code. There are varying time frames for which convictions remain on an individual's criminal record. For example, fines remain on the record for 2 years from the date of payment, unconditional convictions for 5 years from date of release from prison, and suspended sentences for 3 years from the conviction date. Any older convictions will be struck from the record.[35]

Portugal's criminal record system is an electronic database manned and maintained by Portugal's Direcção Geral da Administração da Justiça (General Direction for the Administration of Justice, DGAJ).[73] The system contains the records of Portuguese citizens that reside in Portugal, Portuguese nationals that live abroad and any foreign citizens that reside within Portugal.[73] Disclosure of an individual's criminal record is allowed at the request of the individual; themselves, or a third party with written consent of the individual. For example, an employer may request to see their possible employee's criminal record with their consent. However, the application must be made in person.[73] The certificate regarding criminal records in Portugal is called a "certificado do registo criminal" (certificate of criminal registration) which conveys whether an individual has a criminal record. An extension of this is a more detailed certificate regarding an individual's criminal activities which provides evidence for an individual to be employed in a job where they have access to large sums of cash, need high security clearance or supervise children.[73] This particular certificate is granted in a similar way to Australia's Working With Children Check, which supplies an employer with information regarding any previous criminal activity and ensures that convicted criminals are not employed in the same areas where they may have previously committed crimes.[73][85] Applications for the certificates can be made through several channels, there is a central repository for criminal records located in Lisbon, alongside a vast selection of regional courts and their administration services throughout Portugal that can provide individuals with certificates and for Portuguese nationals residing overseas, applications can be made through embassies and consulates.[73] However, none of the channels through which the certificates are available provide translation services, and therefore the certificate produced is always written in Portuguese, even when produced by an embassy in a non-Portuguese-speaking state.[73]
We spent over 40 hours evaluating background check services. To test them, we searched for three people with names ranging from common to uncommon. After purchasing reports from each company, we checked them for accuracy. Based on our results, Intelius is the best background check company overall. It has some of the lowest prices we saw, and its reports include information about work history, addresses and criminal records. The reports are current and especially useful for finding email addresses, since it pulled results other background searches didn’t find.     

The database that holds data about the criminal records of Estonian individuals is known as The Punishment Register, available for access through the Internet. It is owned and maintained by the Estonian Centre of Registers and Information Systems. Those records that are valid are made completely public. Some misdemeanour cases with the main punishment being less than 200 Euros, and cases involving minors are not published by The Punishment Register.[39]
The Bureau of Criminal Identification and Information manages and oversees the Automated Fingerprint Identification System. AFIS is a statewide, automated fingerprint identification system, which is integrated with mugshot and computerized criminal history (CCH) information. The goal of this system is to provide real time identification of individuals at the time of booking, resulting in timely updates to the state's CCH, mugshot and fingerprint databases. All of this is accomplished in a paperless environment. The Bureau of Criminal Identification and Information provides operational management and technical assistance to the users of the system in addition to ensuring system operational compliance and quality control.

It is the policy of the Portland Public Schools Board of Education that there will be no discrimination or harassment of individuals or groups on the grounds of age, color, creed, disability, marital status, national origin, race, religion, sex or sexual orientation in any educational programs, activities or employment.

In Broken Records, a report on the problems with background checks, the National Consumer Law Center reported that Samuel M. Jackson was allegedly denied employment based on a felony conviction. However, according to the background check, the felony occurred when Jackson was just four years old. In truth, the report misattributed the crime because his name was similar to the actual felon's. Such inaccuracies, according the report, are widespread with background check services because of an “industry-wide lack of accountability” and incentive to “cut corners” in how they collect and attribute information.

While not officially a criminal history repository, the National Driver Register (NDR), operated by the Department of Transportation, maintains information on drivers regarding suspended licenses. The NDR maintains a database of information posted by individual states as mandated by federal law. All drivers who have had their licenses suspended for any reason (including suspensions resulting from several successive minor traffic violations: Massachusetts suspends for three separate speeding tickets over a six-month period) have that information posted by state Registry of Motor Vehicles offices to the NDR.
Criminal histories are maintained by law enforcement agencies in all levels of government. Local police departments, sheriffs' offices, and specialty police agencies may maintain their own internal databases. On the state level, state police, troopers, highway patrol, correctional agencies, and other law enforcement agencies also maintain separate databases. Law enforcement agencies often share this information with other similar enforcement agencies and this information is usually made available to the public.[100]
France has a sex offenders registry but unlike systems such as the United States, does not allow the public to access information regarding the information of cases and individuals who have been convicted of sex crimes, nor does France require the community to be notified of the presence of a sex offender in their neighbourhood as is obligatory in some other countries.[44]
There is no record of dismissed cases or verdicts of not guilty.[6] To access their own criminal record, a person can seek it from their local police authority or send a written request to the Federal Public Service Justice. In terms of public access to criminal records, the following persons and judicial and administrative bodies may be able to gain access to records through the Federal Public Service Justice.
In Chile, citizens can request their own criminal records at the Civil Registrations office or the Registro Civil.[24] According to the Article 19 N°16 of the Constitution of Chile, an employer cannot discriminate based on anything else but personal capabilities to perform at the job offered.[25] One can eliminate one's criminal records by a voluntary checkup, providing your signature two years for first offenses, or five years for more. A person must be complaint of the requisites provided by the law No. 409.[26]

Work history is another good data point to use to find someone you’ve lost track of. It can also be helpful if you need to reconstruct your own work history as you write your resume. BeenVerified reports have accurate information, though is some cases you may have to purchase add-ons – for example, if you want information about property or other legal matters. You need to pay for a subscription to get background checks. This costs around $27 a month, and you pay an additional $2.99 to download the report.
Most background checks cost between $40 and $50 – Instant Checkmate charges around $35 for a monthly subscription. This is a great value because for the cost of one report elsewhere, you can view as many as you want at Instant Checkmate. However, you have to pay $2.99 for any report you wish to download. We ran background checks on three people, and Instant Checkmate’s reports were always the most current and had the fewest inaccuracies. It was especially accurate on phone numbers and emails, listing some that other services omitted. One of our subjects had moved recently, and their report didn’t include their new address, so information that’s changed in the past six months may not show up. It’s easy to search for your target, no matter how common their name is. We had no trouble finding any of our subjects. By including a middle name, you can quickly narrow the results so you don’t have to scroll through pages of names. The more information you add, the easier it is to find who you’re looking for.

The company’s new service, launching today, is called Better Future. It’s an extension of Checkr’s larger mission to help people with criminal backgrounds get jobs. One in three adult Americans has a criminal record, meaning that they either have been arrested on a felony charge (even if they weren’t convicted) or on a misdemeanor charge that a state agency has requested the FBI keep on file, Politifact reported last year.

Probably the most damage an arrest record can do for an individual who was not convicted is send a questionable signal to a potential employer. An arrest record alone is not a sufficient reason for a prospective employer to deny employment, but there is a wide range of other reasons an employer can use to decline a job application. The best action to take when a previous arrest may be a problem is consulting with an expungement attorney for a full evaluation of the chance that an arrest record can be removed from public view.
In the event that the name and date of birth of the applicant matches any sexual offence record in the system, he/she is required to submit fingerprints to the RCMP for a physical confirmation.[17] Criminal record check is an integral part of the process for obtaining security clearances regardless of level of access. Some provinces may require high-risk professions to be screened to ensure public safety. For example, the BC Ministry of Justice requires all healthcare professionals, practicum students in healthcare, childcare facilities staff and volunteers, school and hospital staff regardless of position to undergo a CRC via the Criminal Records Review Program.[15] Many Canadian universities require a Criminal Records Check or other screening procedure (e.g. Child Abuse Registry Check, Vulnerable Sector Screen) as a condition of admission into its programs.[18][19]

Generally speaking, the disclosure of a criminal record is only released to the individual who committed the offense and only when that individual has handed power of attorney to another or they are declared legally incompetent may another successfully apply to receive the disclosure. Perspective employers are not allowed access to disclosure at any time.[43] Applications must be made through the Casier Judiciare National (National Judicial Record, CJN) and are free of charge. Applications can be submitted online, via email, in person or by post of fax but are limited to the CJN. Criminal record certificates cannot be accessed through a French consulate or embassy at any time.
Judicial data on criminal offences are kept for 30 years after the criminal sentence has become irrevocable. Extensions can occur for non suspended prison sentences, mental hospital orders and youth detention. Data involving Minor offences are stored until five years after the irrevocable settlement of the case – extended to ten years if the individual was sentenced to prison or community service. Eighty years after the birth of the individual, all data is removed.[78]
A criminal record or police record is a record of a person's criminal history. The information included in a criminal record and the existence of a criminal record varies between countries and even between jurisdictions within a country. In most cases it lists all non-expunged criminal offences and may also include traffic offences such as speeding and drunk driving. In some countries the record is limited to actual convictions (where the individual has pleaded guilty or been declared guilty by a qualified court), while in others it also includes arrests, charges dismissed, charges pending and charges of which the individual has been acquitted.
There are a variety of types of investigative searches that can be used by potential employers. Many commercial sites will offer specific searches to employers for a fee. Services like these will actually perform the checks, supply the company with adverse action letters, and ensure compliance throughout the process. It is important to be selective about which pre-employment screening agency one uses. A legitimate company will be happy to explain the process. Many employers choose to search the most common records such as criminal records, driving records, and education verification. Other searches such as sex offender registry, credential verification, skills assessment, reference checks, credit reports and Patriot Act searches are becoming increasingly common. Employers should consider the position in question when determining which types of searches to include, and should always use the same searches for every applicant being considered for one.
