It may or may not shock you to learn that recordkeeping isn’t perfect. Checkr has decided to give job seekers a window into their records primarily to help them detect any inaccuracies and have them changed. In some markets, Checkr will be able to connect people with a free service, Clear My Record, to see if they qualify for a reduction or dismissal. That process requires submitting an application to attorneys, as well as an approximately four-week waiting period to hear about results or next steps.
Go to your local police department where you reside or last resided in the United States, request that the police conduct a local or state criminal records search and provide you with a document reflecting that there is no history of a criminal record. Local police departments may require your personal appearance in order to conduct the search.  You should determine whether the country where you intend to use the records check requires that it be authenticated. Probably the most damage an arrest record can do for an individual who was not convicted is send a questionable signal to a potential employer. An arrest record alone is not a sufficient reason for a prospective employer to deny employment, but there is a wide range of other reasons an employer can use to decline a job application. The search may be free, but in order to pull a complete report, you will have to sign up for a membership. Arrest Records can be obtained for free on your own, but requires a lot of work to find the appropriate court records, or arrest records you are looking for. Arrest records can show up on background check reports when you perform a people search or a background check on someone. Convictions, felonies and other related court documents may also show up on a background check report, but this varies from person to person.
Arrests that do not lead to an official finding of guilt, i.e. a conviction or the acceptance of a caution, are not considered part of a person's criminal record and are not typically disclosed as part of the process. However, an enhanced disclosure may include such additional information, which is supplied at the chief police officer's discretion. Enhanced disclosures are typically used to screen applicants for positions such as police officer, social worker, teacher which involve contact with vulnerable groups and children.

The National Law Enforcement Telecommunications System (NLETS) is an interface to search each state's criminal and driver records as well as the License Plate Reader (LPR) records going back one year maintained by the U.S. Customs and Border Protection (CBP). Thus through NLETS, a law enforcement agency in one state could search for someone's criminal and driver records in another state. NLETS potentially serves as a better tool to search for minor misdemeanors and traffic violations that would not be in the NCIC.

Checkr’s view is that, in many cases, minor offenses unrelated to the work in question shouldn’t limit people’s prosperity (e.g. someone with a traffic violation applying to work in a call center). The FBI’s CJIS Division will authenticate U.S. Department of Justice Order 556-73 fingerprint search results for international requests by placing the FBI seal and signature of a Division official on the results, if requested at the time of submission. Documents prepared in this manner may then be sent to the U.S. Department of State Authentications Office by the requestor to be authenticated, if necessary. Please be sure to indicate the country in which the document is to be used. The FBI procedure became effective January 25, 2010, and applies only to documents finalized after that date. Requests to authenticate previously processed results will not be accepted.
Malta has recently introduced a sex offenders register. The legislation which enacted the introduction of the register is the Protection of Minors Registration Act 2012.[74] Under the Act current and prospective employers can request information about employees contained in the register by application to the Attorney General. The application will then be heard in court. The Act states that it is a criminal offence to employ a registered person into an entity which deals with education, care, custody, welfare or upbringing of minors.

For the formerly incarcerated, a criminal record is a barrier to reentering the workforce, making it much more difficult for ex-felons to rehabilitate into society. The full and detailed records of a one's criminal past can be available to a certain range of individuals and authorities, under the terms 'general use' and 'judicial use'. Under Article 575, general use dictates criminal records will and can be supplied for prospective members of the Bar, future notaries and chartered accountants as they are a prerequisite for registration.[46]

The legal system is complex. Free Public Arrest Records are broken down into specific categories. Driving, Theft, Assault, Arrest, Inmate, Immigration, Sex Offender Records are some examples. All of these are public records and are open to public access and review. Investigative work or background checks normally include criminal records in one way or another. Hence, it would be good for police work, neighborhood watch or perhaps for social background checks.
Generally speaking, the disclosure of a criminal record is only released to the individual who committed the offense and only when that individual has handed power of attorney to another or they are declared legally incompetent may another successfully apply to receive the disclosure. Perspective employers are not allowed access to disclosure at any time.[43] Applications must be made through the Casier Judiciare National (National Judicial Record, CJN) and are free of charge. Applications can be submitted online, via email, in person or by post of fax but are limited to the CJN. Criminal record certificates cannot be accessed through a French consulate or embassy at any time.

The categories of criminal conviction contained within the Extract from the Criminal Record includes those involving offences against children, sexual offences, violent offences and narcotics offences. Any other convictions not relating to these categories will not be included on the certificate. The Criminal Record Extract for a Visa Applications contains information pertaining to custodial or suspended sentences, community service, fines, juvenile punishments, and overseas decisions against Finnish citizens or permanent residents.[35]
In Sweden, the police has a record of convictions ("Belastningsregistret"). It does not contain arrests, and its information is not available for general public, even regarding serious crimes. Individuals can ask for a copy of their own record once per year, or against a fee anytime. For employment involving children or for security guards etc., a check will be made against the criminal record. Regular employers more and more often require applicants to get a record copy themselves and give the employer. The number of requests for own copies increased from 40,000 to 199,000 between 2003 and 2012.
Employers may investigate past employment to verify position and salary information. More intensive checks can involve interviews with anybody that knew or previously knew the applicant—such as teachers, friends, coworkers, neighbors, and family members; however, extensive hearsay investigations in background checks can expose companies to lawsuits. Past employment and personal reference verifications are moving toward standardization with most companies in order to avoid expensive litigation.
