In the United States, any person, including a private investigator, criminal research or background check company, may go to a county courthouse and search an index of criminal records by name and date of birth or have a county clerk search for records on an individual. Such a search may produce information about criminal and non-criminal charges that do not otherwise appear on a state criminal history abstract.
All the information included in the background reports sold by these services is public information. You could, if you had the time and patience, find the information on your own. This is the value background check services provide – they do the legwork for you by using web-scraping software to mine public data or by purchasing information in bulk from companies, like Facebook and Twitter, who require users to agree to terms allowing the company to sell their information. Once the services have the public information, they collate it into a report for easy reading. 
In Canada, criminal records are stored in Criminal Records Information Management Services,[10] a centralized database operated by the Royal Canadian Mounted Police under the Canadian Police Information Centre (CPIC) since 1972.[11] The database includes all convictions for which a pardon has not been granted, all charges regardless of disposition, outstanding warrants and charges, all judicial orders and other information that might be of interest to police investigations.[12]

Each individual who has an entry in the Interstate Identification Index has a unique "FBI number" that is used to identify a specific individual. It compensates for the fact that an individual may provide several false names, or aliases, to a law enforcement agency when he or she is booked. An individual may also lie about his or her date of birth or social security number as well, making an independent, unique identification key necessary.

Formally, an arrest only refers to those times when an individual is seized and taken into custody. However, depending on each individual law enforcement agency’s own reporting requirements, their arrest records may contain additional information. However, Nick Clements argues in "Should Identity Theft Really Scare You?" that you shouldn’t necessarily lose sleep about it. While identity theft is on the rise, the vast majority of the cases are reported as account takeovers – instances where someone uses your financial information to make purchases or gains entry into and takes over an account. These are, according to Clements, nothing to worry about. Since this kind of identity theft is common enough, banks and financial institutions are very good at making things right, so long as you report the fraud as soon as possible. In fact, 96 percent of people who experienced identity theft never had to pay a dime.

Law No 290 governs the disclosure of criminal records in Romania. The criminal records of all Romanian citizens are kept in a Central Criminal Records database by the General Inspectorate of the Romanian Police. Police stations gather and keep the records of conviction status of individuals born in Romania, and it is their responsibility to keep these records up-to-date. This type of criminal record disclosure is named the Criminal Records Certificate. These Certificates contain personal information including full name, unique identification number, date and place of birth, most recent address, name of parents, and the details of the committed offence, rehabilitation and extradition information.
An arrest record appears on a person’s background report when the person’s been apprehended by law enforcement on suspicion of criminal activity. It’s important to note, however, an arrest record is different from a criminal record. The former indicates only that the person was apprehended by law enforcement, but does not indicate guilt. An arrest record can show the person was held for questioning, taken into custody, held for investigation, or charged and tried.
Generally speaking, the disclosure of a criminal record is only released to the individual who committed the offense and only when that individual has handed power of attorney to another or they are declared legally incompetent may another successfully apply to receive the disclosure. Perspective employers are not allowed access to disclosure at any time.[43] Applications must be made through the Casier Judiciare National (National Judicial Record, CJN) and are free of charge. Applications can be submitted online, via email, in person or by post of fax but are limited to the CJN. Criminal record certificates cannot be accessed through a French consulate or embassy at any time.

Some background check services argue that the list of associates in their reports provides a bigger picture of the individual’s credibility. The logic is that if a person’s associate list is filled with people who have criminal records, they are less credible than someone who’s associations are businessmen. However, it’s important to realize these lists are not an accurate representation of the quality of a person’s actual associations. Since these lists are computer generated, much of the context in the relationship is lost. 

In Lithuania, judgments will be removed from the Register immediately after the completion of the sentence, depending on the seriousness of the sentence. For high-risk recidivists (10 years from completion of sentence), very serious offences (8 years), serious offences (5 years), less serious offences (3 years), suspended sentences (immediately on completion of sentence). In cases of minors, convictions incurring custodial sentences remain unspent for half the period of time stated above.[43]

Since the beginning of 2012, the data providing for the criminal records of Estonian citizens is available online. Any individual with a criminal record can access the electronic version of the database to receive this information for free. In order to view information pertaining to a non-related individual, then a fixed fee must be paid to the Ministry of Justice of the Republic. The individual's name and identification in number is also required to view their criminal record. However, there still remain some restrictions on access to this register, including protecting access to information on the criminal records of minors.[40]
