In Cyprus, criminal records are held by the Criminal Investigation Office of Cyprus Police[29] which forms part of the Republic of Cyprus Minister of Justice and Public Order. A Clear Criminal Record Certificate or existing Criminal Record can be requested by individuals through application to the Criminal Investigation Office. Applications can be made in person at the Central Police Station in Nicosia. Criminal records in Cyprus are maintained for life.

There is no official sex offender registry in Ireland. However, under the Sex Offenders Act 2001 which came into force in June 2001, an unofficial registry exists and is held centrally by the Gardaí. The location of sex offenders in Ireland is provided by a certificate issued by the court, stating that the convicted person is subject to the requirements of the Sex Offenders Act 2001 and is now obliged to provide certain information including their name and address to the Gardaí. Therefore, this certificate system is commonly referred to as the Sex Offenders Register, as it allows the details of all sex offenders subject to the requirements of the Sex Offenders Act 2001 to be held centrally by the Gardaí.[61]

Individuals in Australia can obtain a national criminal history to check themselves, and certain organisations can apply for one on their behalf. A person may be required to undergo a criminal record check for a variety of reasons, including employment screening, volunteer work, preparing for a court appearance, visa applications, firearms licencing, or to satisfy a statutory requirement. Individuals can obtain a national criminal history through two ways:


Arrest records are official public records, completed by law enforcement agencies, when a person is placed under arrest. An arrest occurs when someone is seized and taken into custody. Local, state, and federal law enforcement agencies all maintain arrest records, and the agency responsible for reporting the arrest is the agency that actually made the arrest. The responsible agency will be determined by a number of factors including jurisdiction and the crime charged. While law enforcement agencies are responsible for reporting, arrest records may also be available from state and federal courts. Federal agencies with the power to arrest include: FBI, ATF, and DEA agencies, as well as any other federal agency given police power from the DHS to the DOE. Most states have at least one state-level law enforcement agency, and many have multiple law enforcement agencies. These agencies usually include some type of highway patrol and game wardens in addition to other state-specific agencies. Local police may include county or municipal law enforcement agencies, and are responsible for the vast majority of arrests.
While a person’s LinkedIn profile isn’t going to tell you about their criminal or civil records, it certainly provides a great deal of information about their background. You can make your own assessment about what is or isn’t a red-flag, such as gaps in work history or information that doesn’t match with what they told you. For example, if you check on someone you met on a dating app, you can confirm where they went to school and where they work before committing to meet them.

Formally, an arrest only refers to those times when an individual is seized and taken into custody. However, depending on each individual law enforcement agency’s own reporting requirements, their arrest records may contain additional information. In addition to a report of actual arrests, you may find information in an arrest record relating to a person being questioned, detained, investigated, charged with a crime, indicted, or facing trial.

Checkr is one of many companies building technology to help consumers review their data. In the wake of the Facebook Cambridge Analytica scandal in March, the social media platform rolled out a step-by-step guide to help users download and delete their user data. In June, blockchain-based startup Hu-manity.co, which is working to give people access to and control of their medical records, launched a campaign to add a 31st human right to the United Nations Declaration on Human Rights: “Everyone has the right to legal ownership of their inherent human data as property.”

Drug tests and credit checks for employment are highly controversial practices. According to the Privacy Rights Clearinghouse, a project of the Utility Consumers' Action Network (UCAN): "While some people are not concerned about background investigations, others are uncomfortable with the idea of investigators poking around in their personal histories. In-depth checks could unearth information that is irrelevant, taken out of context, or just plain wrong. A further concern is that the report might include information that is illegal to use for hiring purposes or which comes from questionable sources."
In Hong Kong, criminal records are maintained by the Hong Kong Police Force. Unlike other countries listed on this article, Hong Kong authorities do not allow for access to criminal records by employers or school purposes. The Chief Executive of Hong Kong has the sole power to pardon offences committed in Hong Kong under section 12 of article 48 Basic Law of Hong Kong. "The Chief Executive of the Hong Kong Special Administrative Region shall exercise the following powers and functions... To pardon persons convicted of criminal offences or commute their penalties".

If it's very important that the background check be completely accurate, you may want to consider hiring a private investigator. However, most of the time, such background investigations are reserved for high-level pre-employment investigations, executive-level background checks and board-of-director confirmations, according to the Diligentia Group, a New York-based private investigation firm.

This is basically the FBI's rap sheet (Record of Arrest and Prosecution). It contains information voluntarily reported by law enforcement agencies across the country, as well as information provided by other federal agencies. It contains information on felonies and misdemeanors, and may also contain municipal and traffic offenses if reported by the individual agencies.
Believe it or not, almost all of this information is public record by law, and is available to anyone who is willing to make the effort to search for it. Some jurisdictions make it incredibly simple, and have dedicated web portals that allow you to search. Others are stuck in the paper age, and often require an on site search in the county courthouse. This can be done by using a “court runner”, as well.
Each individual who has an entry in the Interstate Identification Index has a unique "FBI number" that is used to identify a specific individual. It compensates for the fact that an individual may provide several false names, or aliases, to a law enforcement agency when he or she is booked. An individual may also lie about his or her date of birth or social security number as well, making an independent, unique identification key necessary.

Each criminal record certificate has two components: the first regarding the individuation of the person and the second consisting of the content of the person's prior criminal acts. Every certificate must contain: information concerning the person's identity including the paternal surname and if they are married, and the final judgement/s passed down by a court. Specifically, Article 574.2 CCrP states that certificates must record:

Additionally, public records and professional listings compiled during background checks can help employers confirm a candidate’s work history and qualifications, making it easier to spot false information on a CV.
Arrests, prosecutions and the disposition of the case for persons arrested for Class B misdemeanor or greater violation of Texas criminal statutes, as well as Class C convictions or deferred adjudications that are reported to the Department. The statute identifies many of the actual data elements. In addition, although not required by statute, CCH has traditionally included limited supervision data reported to DPS by TDCJ.

Go to your local police department where you reside or last resided in the United States, request that the police conduct a local or state criminal records search and provide you with a document reflecting that there is no history of a criminal record. Pre-employment screening refers to the process of investigating the backgrounds of potential employees and is commonly used to verify the accuracy of an applicant's claims as well as to discover any possible criminal history, workers compensation claims, or employer sanctions. For example, CBC News of Canada reported that fraud in the workplace cost Canadian Businesses over $3.2 Billion in 2011.[6]
